Colorado Ridesharing Laws
Under Colorado Revised Statute § 40-10.1-604(2), a TNC must obtain primary automobile liability coverage of at least $1 million dollars per occurrence for incidents involving a driver during a prearranged ride. A driver may be deemed to be engaged in a prearranged ride even if he or she does not actually have a passenger in his or her vehicle, so long as he or she has accepted a ride request and is on his or her way to pick up the passenger.
When a driver is not engaged in a prearranged ride, the following minimum primary automobile liability coverage limits apply:
- $50,000 to any one person
- $100,000 to all persons in any one accident
- $30,000 for property damage
Essentially, a TNC is unlikely to be held liable when its driver is not engaged in a prearranged ride, and that driver alone is usually the person who is legally subject to injury claims in such cases. Uber, Lyft, or other TNCs may also argue that they are not liable when a driver who is engaged in a prearranged ride does not comply with certain company requirements of its drivers.
